Charles City man convicted of December 2015 robbery

A Charles City man was convicted of first-degree robbery last week in Floyd County District Court for a December 2015 incident in which the victim was hit in the head and choked.

Donald Edward McIntyre, 37, was convicted Dec. 7 after a jury deliberated for less than three hours.

McIntyre was accused of going to a home in the 1200 block of E Street in Charles City on Dec. 27, 2015, where he confronted a person there about owing money to someone named “Tom,” according to court documents.

He then hit the victim in the head with a club and attempted to choke him with the club almost to the point of passing out, court records say. The victim fought back and offered McIntyre about $100 to leave. The victim gave McIntyre the money and McIntyre ran off, leaving a large knife behind at the crime scene.

The criminal complaint, which was not filed until almost a year after the incident, on Dec. 19, 2016, said McIntyre was identified through a photo lineup and by DNA obtained from the knife and from the club by the Division of Criminal Investigation Crime Lab and matched to McIntyre.

The report also said footprints left at the scene matched boots that were later seized at McIntyre’s residence.

McIntyre was arrested on Christmas Eve 2016 in Charles City.

During the trial McIntyre testified on his own behalf and his wife testified as an alibi witness.

Robbery in the first degree is a Class B felony, punishable by up to 25 years in prison with a mandatory term of 70 percent of the time (17.5 years) before being eligible for parole or early release.

Sentencing has been set for Feb. 9, 2018.
