Third man sentenced in Charles City burglary and assault

A Charles City man who pleaded guilty to reduced charges in connection with a Charles City residential break-in and assault has been sentenced to probation and given a chance at a deferred sentence.

Dajon Joseph Richard, age 19, of Charles City, entered a written plea of guilty on July 14 for his involvement in breaking into an occupied apartment in the 900 block of 13th Street in Charles City on Feb. 6, assaulting a resident at the apartment and stealing a safe.

Richard had originally been charged with burglary in the first degree, a Class B felony eligible on conviction of a prison term up to 25 years.

Richard pleaded guilty to a charge of criminal mischief in the third degree, an aggravated misdemeanor, and assault causing bodily harm, a serious misdemeanor.

On Aug. 16, Floyd County District Court Judge DeDra Schroeder sentenced Richard to probation for two years; a penalty of $855, suspended; payment to the victim and payment of $1,500 in attorney fees and court costs.

If Richard successfully completes all the provision of his sentence including probation, his public record of the charges and criminal conviction will be expunged.

Previously in the case, Booker Dean Wilder-Kapping, age 18, was sentenced to a suspended sentence of up to two years and a fine of $855 plus 15% surcharge, also fully suspended, after pleading guilty to a charge of criminal mischief in the third degree, an aggravated misdemeanor.

That charge had been reduced from a Class B felony charge of first-degree burglary.

Wilder-Kapping was also sentenced to 365 days in jail with all but seven days suspended and a $450 fine plus 15% surcharge, fully suspended, after pleading guilty to a charge of assault causing bodily injury, a serious misdemeanor.

Wilder-Kapping was ordered to serve two years of probation and ordered to undergo a substance abuse evaluation and follow the recommendations.

Chriz Paul Richard, age 21, Charles City, had also earlier pleaded guilty to the reduced charge of attempted burglary in the third degree, an aggravated misdemeanor.

He was sentenced to 87 days in jail, with credit for 87 days already served; a fine of $855 plus 15% surcharge, suspended; plus other costs; and restitution of $318.50 to repair a door broken in the apartment.
