Floyd County attorney disputes Lindaman’s evidence claims

The Floyd County Attorney’s Office disputes repeated claims by a convicted sex offender facing a new charge that key evidence for his defense is being withheld.

County Attorney Rachel Ginbey in a notice to the court filed Oct. 22, said Doug Lindaman, who is charged with third-degree sexual abuse and is representing himself in court, has what her office has. “All items requested by the Defendant that are in the possession of the State have been provided to the Defendant,” she stated.

A court hearing is scheduled for 10 a.m. Nov. 2 at the Floyd County Courthouse regarding multiple motions made by Lindaman. District Court Judge Chris Foy said he set aside 30 minutes for the hearing.

Lindaman was charged in late August with third-degree sexual abuse for a 2011 incident. The charges were filed as he was running for the Charles City School Board, a race he lost.

His trial is scheduled for Jan. 12.
