Man charged with assaulting officer after bar fight

A Charles City man has been charged with assault on a peace officer after allegedly getting into a fight at a local bar.

Kjoe Joseph, 34, was charged with assault on persons in certain occupations with intent of injury, a Class D felony, as well as consumption of alcohol in a public place, disorderly conduct – fighting or violent behavior, and interference with official acts, all simple misdemeanors.

According to court documents, Charles City officer Duane Ollendick was dispatched to Hot Shots bar for a fight in progress shortly before 6 p.m. Friday, Feb. 2.

“Upon arrival, I entered the bar and could hear a male subject yelling at the bartender. I went to approach the subject and he immediately turned towards me and began swinging his arms at me,” the report said.

“I was able to duck out of the way and pulled my Taser out of its holster and pointed it at the subject’s chest area and instructed him to the ground. He refused and turned to run from me towards the door when I deployed my Taser,” Ollendick wrote.

“The subject was taken to the ground and handcuffed. He resisted the entire time,” the report said.

Assault on persons in certain occupations with intent of injury is punishable by up to 5 years in prison and up to a $7,500 fine upon conviction.

Joseph was taken into custody and later released on his own recognizance by a magistrate. He is being represented by Nellie O’Mara of Mason City.
