Charles City man Fiala charged with sexual abuse

A Charles City man has been charged with third degree sexual abuse for allegedly having sex with a person who was unable to give consent.

Kevin Eugene Fiala, age 40, is charged with the C felony for an act that allegedly occurred Nov. 7 in Charles City.

According to the criminal complaint filed in Floyd County District Court, Fiala had sex with a person who “was asleep, did not give prior consent, and was not able to give consent during the time of the act.”

The court issued a no-contact order between Fiala and the alleged victim.

A preliminary hearing has been set for Nov. 27.
