Charles City man sentenced to 25 years on robbery charge

A Charles City man convicted of first-degree robbery has been sentenced to up to 25 years in prison for an incident in which a man was hit in the head and choked.

Donald Edward McIntyre, 37, was convicted by a Floyd County jury in December. He was sentenced last week to up to 25 years in prison, with credit for time already served.

First-degree robbery is a Class B felony. There is a mandatory period of 17½ years that he will have to serve before being eligible for parole or early release.

District Court Judge Chris Foy also sentenced McIntyre to pay $3,943 in restitution to his victim.

McIntyre had filed motions in December for a new trial or no judgment, but Foy had denied those motions. After sentencing, McIntyre filed a notice of appeal. Such filings are common in cases of criminal convictions.

McIntyre was charged with attacking a man in the man’s driveway in the 1200 block of E Street in Charles City on Dec. 27, 2015, demanding money from the man.

He hit the victim in the head with a club and attempted to choke him with the club almost to the point of passing out, court records say. The victim fought back and offered McIntyre about $100 to leave. The victim gave McIntyre the money and McIntyre ran off, leaving the club and a large knife behind.

The criminal complaint, which was filed on Dec. 19, 2016, almost a year after the incident, said McIntyre was identified through a photo lineup and by DNA obtained from the knife and from the club by the Division of Criminal Investigation Crime Lab and matched to McIntyre.

The report also said footprints left at the scene matched boots that were later seized at McIntyre’s residence.

McIntyre was arrested on Christmas Eve 2016 in Charles City.
